Spousal sponsorship is a process under the family class sponsorship category that allows Canadian citizens and permanent residents to sponsor their spouses or partners to immigrate to Canada.
Eligibility Requirements:
Who is eligible to sponsor their spouse, partner, or child:
To sponsor your spouse, partner or dependent child, you must be
- At least 18 years old
- A Canadian citizen, a permanent resident of Canada, or a person registered in Canada as an Indian under the Canadian Indian Act.
- Must show that you can provide basic needs for your spouse or partner, partner, or dependent child.
- Meet certain financial requirements to sponsor your spouse, partner, or dependent child.
Who can't sponsor their spouse, partner, or child:
- Non-Canadian citizens, non-permanent residents, or those not registered under the Canadian Indian Act.
- Individuals under 18 years of age.
- Those who have not fulfilled financial support obligations from previous sponsorships.
- Defaulters on immigration loans.
- Individuals are subject to a removal order.
- Individuals detained in jail, prison, or penitentiary.
- Individuals in receipt of social assistance for reasons other than disability.
- Individuals declared bankrupt and haven't been discharged.
- Individuals who are in default of a previous sponsorship undertaking.
- Individuals who were sponsored as a spouse or partner and became a permanent resident less than five years ago.
Who You Can Sponsor:
- Your spouse, common-law partner, or conjugal partner.
- Dependent children, including adopted children, under 22 years of age.
- Children over 22 years old who are financially dependent on their parents due to a physical or mental condition.
How to Apply?
To apply for spousal sponsorship in Canada, you need to take the following steps:
Check Your Eligibility
Make sure you meet the eligibility criteria to sponsor your spouse or partner, including being a Canadian citizen or permanent resident.
Gather Required Documents
Collect all necessary documents for both the sponsor and the sponsored spouse or partner. The documents include proof of identity, marriage certificate, proof of relationship, and financial documents.
Complete the Application Package
Download the spousal sponsorship application package from the IRCC website, including the document checklist, forms and instructions.
Pay Application Fees
Pay the required sponsorship fee, the right of permanent residence, and biometric fees online using the IRCC payment portal.
Submit the Application
Mail the completed application package, all supporting documents, and proof of payment to the appropriate address in the application guide.
Provide Additional Information (if requested)
IRCC may request additional information or documents to support the application. Respond promptly to any requests to avoid processing delays.
Attend Interviews (if required)
In some cases, IRCC may request an interview with the sponsor or the sponsored spouse or partner to assess the application.
Receive Decision
Once the application is processed, IRCC will notify you of the sponsorship and permanent residence application decision.
Processing Time
The processing time for spousal sponsorship applications in Canada varies based on factors such as the location of the application, completeness of documentation, or verifications and type of sponsorship, i.e. inland spousal sponsorship or outside Canada spousal sponsorship program. However, Immigration, Refugees, and Citizenship Canada (IRCC) processes most spousal sponsorship applications within 12 months
