LMIA (Labour Market Impact Assessment)

An LMIA stands for Labour Market Impact Assessment. It is a document obtained by Canadian employers through Employment and Social Development Canada (ESDC) that allows them to hire foreign workers when no Canadian worker or permanent resident is available to do the job.

How to Get an LMIA

Employer Application: The employer submits an application to Employment and Social Development Canada (ESDC) for an LMIA.

Job Offer and Description: The employer provides details of the job offer, including job description, requirements, and salary.

Labour Market Assessment: ESDC assesses the impact of hiring a foreign worker on the Canadian labour market, considering factors like job availability and wages for Canadians.

Compliance with Regulations: The employer must comply with all relevant regulations and provide accurate information throughout the process.

Decision Notification: ESDC notifies the employer of the decision regarding the LMIA application.

LMIA Approval: If approved, the employer receives an LMIA, which the foreign worker can use to apply for a work permit in Canada.

How to Hire if You Need an LMIA:

The TFWP program allows Canadian employers to hire foreign workers to fulfill labour and skill shortages. 

The Canadian employer must apply for an LMIA with the ESDC, which certifies the need to hire a foreign worker. Once the LMIA is approved, you should provide a copy of the confirmation letter to each temporary foreign worker and tell each of them to apply for a work permit or permanent residence. 

To apply for a work permit, a worker needs

  • a job offer letter
  • a contract
  • a copy of the LMIA, and
  • the LMIA number

How to Hire if You Don't Need an LMIA:

The International Mobility Program (IMP) in Canada facilitates hiring foreign workers without requiring an LMIA. 

For hiring a temporary foreign worker through the International Mobility Program, you need to: 

  • submit an offer of employment form through the Employer Portal
  • Pay an employer compliance fee 

LMIA Processing Time

The processing time for LMIA-based work permit applications depends on various factors. It includes the type of applications, volume of applications received and the current workload of ESDC. The average processing time it takes to process a complete application is around ten days to 2 months, depending on the type of application.
